Please carefully read the following Terms and Conditions of Use that govern your participation in any product(s) and/or program(s) provided and distributed by Cheviron Coaching, LLC. 

Terms and Conditions of Use for Cheviron University

These Terms and Conditions of Use (“Agreement”) are a legal agreement between you and Cheviron Coaching, the owner and developer of Cheviron Coaching’s online course training program(s) as well as any associated Affiliate Program(s), Community Feature(s) via Facebook and/or Kajabi, group or virtual mastermind and Question and Answer Sessions, and website(s) ("Cheviron University" or "Online Training Program(s)").  By registering or enrolling for any service provided as part of Cheviron University, or by attending any part of Cheviron University, you agree to be bound by all of the terms (the “Terms”) set forth in this Agreement.  IF YOU DO NOT AGREE TO THE TERMS, DO NOT REGISTER FOR CHEVIRON UNIVERSITY.  These Terms are subject to change at any time, effective upon notice to you.

  1.   Program Nature:

The online training program(s) are designed for educational purposes only.  They do not guarantee professional certification or licensure.  It is your responsibility to verify certification requirements in your jurisdiction.  Opinions, advice, statements, or other comments should not necessarily be relied upon and are not to be construed as professional advice by Cheviron Coaching.  Cheviron Coaching does not guarantee the accuracy or completeness of any of the information or material provided as part of the online training program and are not responsible for any loss resulting from your reliance on such information or material.

  1.   Program Access:

Upon enrollment or registration, you will receive access to program materials for the duration specified at the time of enrollment.  Access may be subject to renewal fees.

  1.   Term and Termination:

The term of this agreement shall be for the duration of the online training program, or for a maximum of 2 years, whichever is greater. Cheviron Coaching reserves the right to terminate your access to the program a) for violations of these terms and conditions, b) due to unavailability of any back-end software system, c) due to dissolution or cessation of its business, or d) for any other reason or circumstance, foreseen or unforeseen, at Cheviron Coaching's discretion. Notwithstanding the foregoing, either party may cancel this agreement at any time for any or no reason, upon which termination access to Cheviron Coaching’s online training program will be immediately terminated.

  1.   Intellectual Property:

All program materials, including but not limited to videos, text, images, and downloadable resources, are protected by copyright and/or trademark.  You may not reproduce, transmit, distribute, or share these materials without explicit written permission from us.

  1.   Privacy:

Cheviron Coaching may collect and store personal information for program registration and communication purposes.  Your data will be handled in accordance with our privacy policy which can be viewed at https://mycourses.chevironcoaching.com/privacy-policy. 

  1.   Modifications:

Cheviron Coaching reserves the right to modify program content, schedule, or terms without prior notice.  You will be informed of any significant changes that may affect your participation.

  1.   Payment and Refunds:

Payment for the online training program(s) is required as specified at enrollment or registration. Cheviron Coaching does not warrant or grant refunds unless such a refund is issued due to a special circumstance at which the refund may be made at the sole discretion of Cheviron Coaching. 

  1.   Conduct:

You agree to engage in our programs in a respectful and professional manner.  Cheviron Coaching reserves the right to remove participants who engage in disruptive or inappropriate behavior without any refund.

  1.   Limitation of Liability:

While Cheviron Coaching strives to provide accurate and valuable content, Cheviron Coaching does not guarantee the accuracy, completeness, or applicability of the online training program materials.  In no event will Cheviron Coaching, its officers, employees, agents, affiliates, parent company(s), subsidiary(s), licensees, and/or web hosting services be liable for any direct or indirect, incidental, special, or consequential damages as a result of your participating in the online training program, whether for negligence or otherwise.  Your sole remedy for any breach or default of this Agreement by Cheviron Coaching shall be a return of any fees paid to Cheviron Coaching for any services provided under this Agreement.  You indemnify and agree to defend and hold harmless Cheviron Coaching its officers, employees, agents, affiliates, parent company(s), subsidiary(s), licensees, web hosting services, and third parties for any losses, costs, liabilities and expenses (including but not limited to court costs, legal fees, awards, or settlements) relating to or arising out of your participating in the online training program, including any breach by you of the Terms contained in this Agreement.

  1.   No Warranties:

Cheviron Coaching provides the online training program on an "as is" basis and does not make any warranty, express, implied, limited or other with respect to the training provided, including but not limited to implied effectiveness of any ideas or success strategies.  Additionally, Cheviron Coaching does not warrant that the online training program will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the online training program will be corrected.

  1.   Jurisdiction. 

This Agreement or any dispute arising from this Agreement is governed by the laws of Indiana, without regard to provisions of conflicts of law.  Any lawsuit arising from or related to this Agreement shall be brought exclusively before the United States District Court for the Northern District of Indiana, and you hereby consent to the jurisdiction of any such court.

  1.   Entire Agreement

These terms and conditions constitute the entire agreement between you and Cheviron Coaching, LLC regarding Cheviron Coaching’s online training program(s). 

  1.   Feedback and Communication:

Cheviron Coaching welcomes your feedback and questions regarding the online training program.  Please contact us through the designated communication channels for assistance.

  1.   Severability

If any provision is found to be invalid, the remaining provisions will be in full force and effect.

  Waiver

Any waiver or modification of these terms must be in writing and signed by both parties.

By enrolling in Cheviron University, you acknowledge that you have read, understood, and agreed to these terms and conditions.  

You further understand and agree that clicking or pressing on the "I agree" is the electronic equivalent of a written signature on this document.
