Please carefully read the following Terms and Conditions of Use that govern your participation in any product(s) and/or program(s) provided and distributed by Cheviron Coaching, LLC.

Cheviron LIVE Terms & Conditions of Use

These Terms and Conditions of Use ("Agreement") is a legal agreement between you and Cheviron Coaching, LLC, the owner and developer of Cheviron LIVE as well as any associated Affiliate Program(s), Community Feature(s) via Facebook and/or Kajabi, LIVE LIBRARY, and website(s) (“Training Program(s)”). By registering for any service provided as part of Cheviron Coaching’s Training Program(s), or by attending any part of Cheviron Coaching’s Training Program(s), you become a client ("Client") and you agree to be bound by all of the terms (the "Terms") set forth in this Agreement as long as you remain a Client. IF YOU DO NOT AGREE TO THE TERMS, DO NOT REGISTER FOR CHEVIRON COACHING’S TRAINING PROGRAM(S). These Terms are subject to change at any time, effective upon notice to you.

BY CLICKING THE "I AGREE" BUTTON BELOW, YOU AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS. THE MOST CURRENT VERSION OF THE TERMS, WHICH SUPERSEDES ALL PREVIOUS VERSIONS, CAN BE REVIEWED BY GOING TO https://mycourses.chevironcoaching.com/cheviron-coaching-live/terms CHEVIRON COACHING RESERVES THE RIGHT TO CHANGE THE TERMS AT ANY TIME AND WITHOUT NOTICE TO YOU.

Description of Service. Cheviron Coaching’s Training Program(s) are live virtual and/or recorded webinar training programs wherein Clients having paid memberships receive training from Cheviron Coaching and/or special guests, at the sole discretion of Cheviron Coaching.

Cheviron Coaching adheres to a Rest / Run Cycle. The schedule thereof is at the sole discretion of Cheviron Coaching.

Cheviron LIVE meets three to four times per month during the Run Cycle, and we "REST" 1 week per month.

Content of Cheviron Coaching’s Training Program(s) may be derived from Cheviron University Training Programs (i.e. Agent Success Program, TEAMS Program, etc.) as well as created week-to-week by Cheviron Coaching, special guests, and etcetera.
Membership may include access to certain live and/or recorded materials (The LIVE LIBRARY). The inclusion of such live and/or recorded materials is at the sole discretion of Cheviron Coaching and may be added or removed at any time by Cheviron Coaching for any or no reason.
Membership may include access to a Community Feature (i.e. Cheviron Coaching Community Facebook Group). Availability of the Community Feature is at the sole discretion of Cheviron Coaching and may be added or removed at any time by Cheviron Coaching for any or no reason.
Membership may include access to an Affiliate Program (see Exhibit C) Availability of an Affiliate Program, the amount of compensation received to its participating members, the availability of discount(s), and the disbursement of said compensation and/or discounts is at the sole discretion of Cheviron Coaching and may be added, adjusted, or removed at any time by Cheviron Coaching for any or no reason.
See Exhibit B for acceptable and unacceptable activities.

Membership. Membership fees shall be as listed in Exhibit A and may be updated and/or changed at any time by Cheviron Coaching, effective upon notice to you. Membership fees shall be paid monthly or annually and shall be paid before access is provided to Cheviron Coaching’s Training Program(s). Payment of membership fees by Client according to the schedule listed in Exhibit A shall determine which of Cheviron Coaching’s Training Program(s) Client is entitled to access and/or participate in. By paying membership fees, Client agrees to be bound to the present agreement as it pertains to the relevant program. If you cancel your membership or fail to pay the monthly fees, access to Cheviron Coaching’s Training Program(s) will be immediately terminated. If you cancel your membership at any time, and thereafter resume membership, you will be required to resume from the beginning of the relevant program. Furthermore, discount codes may or may not be issued and granted on a per member basis and are at the sole discretion of Cheviron Coaching and may be added or removed at any time for any or no reason.

Privacy Policy. Please review our Privacy Policy at: https://mycourses.chevironcoaching.com/privacy-policy. By accessing and using Cheviron Coaching's services and website, you agree to abide by this Agreement. Your use of our services is also subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review our Privacy Policy to understand how your data is handled and your privacy rights are respected. Your continued use of our services constitutes your acceptance of both this Agreement and our Privacy Policy.
Parental Permission. Cheviron Coaching Training Program(s) are not meant for minors. Cheviron Coaching does not knowingly collect personally identifiable information from minors. If you are a parent or guardian and you are aware that your child has provided Cheviron Coaching with Personal Data, please contact us. If Cheviron Coaching becomes aware that it has collected Personal Data from a minor without verification of parental consent, we will take steps to remove that information from our servers.
SMS / Mobile Texting. When you become a customer of Cheviron Coaching, you will provide your phone number to Cheviron Coaching and Cheviron Coaching may use your phone number to confirm orders, deliver promised ongoing training or communication, and/or to send text updates, promotions, videos, audios, and/or messages related to any of its brands or programs. You may opt-out of receiving any future text messages by simply replying to any text message at any time with the word STOP. By signing up for Cheviron Coaching products, services, or programs you hereby grant Cheviron Coaching permission to text you until you reply STOP. Cheviron Coaching will not sell your phone number and will only communicate with you regarding relevant Cheviron Coaching products, services, or programs.
Term and Termination. The term of this Agreement shall be for the duration of Cheviron Coaching’s Training Program(s), as updated from time to time by Cheviron Coaching, according to the Client’s membership. It shall be within the sole discretion of Cheviron Coaching to suspend or terminate the relationship of any participant who violates any of these terms of use or for any other behavior that Cheviron Coaching in its discretion believes is inappropriate. Notwithstanding the foregoing, either Cheviron Coaching or the Client may cancel this agreement at any time for any or no reason, upon which termination access to Cheviron Coaching’s Training Program(s) will be immediately terminated. To cancel your Membership, cancel through the website and email written notice to [email protected]. Refunds are not granted or warranted.

Limitations of Liability and Indemnification. By using any services provided as part of Cheviron Coaching’s Training Program(s), you agree that in no event will Cheviron Coaching, its officers, employees, agents, affiliates, parent company(s), subsidiary(s), licensees, and/or web hosting services be liable for any direct or indirect, incidental, special, or consequential damages as a result of your accessing the website, participating in Cheviron Coaching’s Training Program(s), and/or using any of the services available thereunder, whether for negligence or otherwise. Your sole remedy for any breach or default of this Agreement by Cheviron Coaching shall be a return of any fees paid to Cheviron Coaching for any services provided under this Agreement. You indemnify and agree to defend and hold harmless Cheviron Coaching its officers, employees, agents, affiliates, parent company(s), subsidiary(s), licensees, web hosting services, and third parties for any losses, costs, liabilities and expenses (including but not limited to court costs, legal fees, awards, or settlements) relating to or arising out of your accessing the website(s), participating in Cheviron Coaching’s Training Program(s), and/or using any of the services available thereunder, including any breach by you of the Terms contained in this Agreement.

Responsibility for Use. You understand and agree that you are solely responsible for your actions and decisions to meet other people who you meet online by virtue of the services provided as part of Cheviron Coaching’s Training Program(s). You understand that Cheviron Coaching does not perform psychological testing or background checks on the individuals who may use Cheviron Coaching’s Training Program(s). You understand and agree that you must take all reasonable precautions before meeting others through Cheviron Coaching’s Training Program(s), which includes, but is not limited to exchanging e-mail first before giving out any personal information and meeting in a public place.

Professional Advice and Completeness of Information. Opinions, advice, statements, or other comments should not necessarily be relied upon and are not to be construed as professional advice by Cheviron Coaching. Cheviron Coaching does not guarantee the accuracy or completeness of any of the information or material provided and are not responsible for any loss resulting from your reliance on such information or material. The information or provided material contained in or made available through Cheviron Coaching’s Training Program(s) cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, financial, medical, psychological, therapeutic, or legal matters. In particular, you should regularly consult a doctor in all matters relating to physical or mental health, particularly concerning any symptoms that may require diagnosis or medical attention. Neither Cheviron Coaching, its officers, employees, agents, affiliates, parent company(s), subsidiary(s), licensees, and/or web hosting services will be liable for any direct, indirect, consequential, special, exemplary or other damages that may result, including but not limited to economic loss, injury, illness or death. You alone are responsible and accountable for your decisions, actions, and results in life, and by your use of Cheviron Coaching’s training, consulting, and/or coaching programs or websites or resources provided, you agree not to attempt to hold Cheviron Coaching liable for any such decisions, actions, or results, at any time, under any circumstance.

Offensive Information or Inappropriate Communication. While it is Cheviron Coaching’s intention to provide a professional and dignified online environment, it is possible that other Cheviron Coaching clients will post or send obscene or offensive materials on the website or to you via e-mail. It is also possible that by using your e-mail address and/or using the community feature(s), other people may, through other means outside the control of Cheviron, have access to personal information about you. Cheviron Coaching, its employees, agents, affiliates, parent company(s), subsidiary(s), licensees, and web hosting services are not responsible for these transmissions or for the release of such information by others about you. Moreover, you agree to refrain from any obscene, offensive, derogatory, or disrespectful communication whatsoever. Not withstanding the foregoing, Cheviron Coaching’s training, consulting, and/or coaching programs, resources, materials, writings, and etcetera occasionally discuss mature topics and language relating to personal and professional growth that may use explicit language or “curse words.” Clients that are uncomfortable with such topics or language should not use Cheviron Coaching programs, websites, or materials. See Exhibit B for additional acceptable and unacceptable activities.

Right to Monitor. Cheviron Coaching reserves the right, but is not obligated, to monitor materials posted in any public area and shall have the right to remove any information deemed offensive, obscene, derogatory, or disrespectful by its staff. Notwithstanding the foregoing, you remain solely responsible for your use of any information contained on the site.

Personal Information. It is agreed that all personal information given to Cheviron Coaching, will be kept confidential by Cheviron Coaching, with the following exceptions: (1) basic biographical information (i.e. age, sex, race) will be posted with your user ID for others to view; (2) you actively chose to post your personal information for others to see; (3) you send a message to another client, which will disclose your e-mail address to that client or (4) you have harassed another person via any service provided by Cheviron Coaching, in which case the confidentiality clause contained in this Agreement is rendered null and void. Moreover, you agree to keep confidential identifying information of others obtained through participation in Cheviron Coaching’s Training Program(s).

Confidentiality. No part of Cheviron Coaching’s Training Program(s) may be distributed, reproduced, stored in or introduced into a retrieval system, or transmitted, in any form, or by any means (electronic, mechanical, photocopying, recording, or otherwise), without the prior written permission from Cheviron Coaching. Any resources, marketing materials, content, information, writings, material, and etcetera furnished during and for any program are provided to the recipient pursuant to a personal, non-assignable license for the recipient to use such information during the program wherein the resources, marketing materials, content, information, writings, material, and etcetera is disseminated, as well as any information it contains, in conformity with the training presented for his or her personal or business purposes not related to training or coaching. Any other duplication, dissemination, use, sale or resale of said information or writings is prohibited. Audio or video recording of all or any part of the program is strictly prohibited.

Solicitation. Misuse of Cheviron Coaching’s Training Program(s) for business development, sales, or marketing purposes, or sharing of Member and/or customer information without the prior approval of Cheviron Coaching is strictly prohibited. Such prohibited solicitation includes promoting any business that may be in conflict of interest with Cheviron Coaching, including but not limited to coaching, training, events, resources, and marketing materials. Violators may be subject to removal and/or cancellation of membership without refund and loss of all rights, access and privileges. Examples of acceptable and unacceptable activities are shown in Exhibit B.

Ownership, Copyrights, Trademarks, Licenses. Cheviron Coaching owns and retains all proprietary and intellectual property rights to Cheviron Coaching’s Training Program(s), trademarks, and/or copyrights. Except for any information that is in the public domain, you are not authorized to reproduce, transmit, or distribute the proprietary information or intellectual property of Cheviron Coaching. By posting information to the website(s) associated with Cheviron Coaching’s Training Program(s), you represent that you have the right to grant permission for use thereof by Cheviron Coaching, and further that such permission for use thereof is granted to Cheviron Coaching.

No Warranties. Cheviron Coaching provides Cheviron Coaching’s Training Program(s) services on an "as is" basis and do not make any warranty, express, implied, limited or other with respect to the services provided, including but not limited to implied effectiveness of any ideas or success strategies listed on any website, or any that are provided in products or programs, or any communicated to our participants during events and programs. Additionally, Cheviron Coaching does not warrant that the service will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the services will be corrected.

Jurisdiction. This Agreement or any dispute arising from this Agreement is governed by the laws of Indiana, without regard to provisions of conflicts of law. Any lawsuit arising from or related to this Agreement shall be brought exclusively before the United States District Court for the Northern District of Indiana, and you hereby consent to the jurisdiction of any such court.

Severability. If any provision is found to be invalid, the remaining provisions will be in full force and effect.

Certification. You certify that you are at least 18 years of age and that your answers to the registration materials for Cheviron Coaching’s Training Program(s) will be truthful. In accessing and using any website(s) associated with Cheviron Coaching’s Training Program(s), you understand and agree that basic information concerning you, given to Cheviron Coaching or entered by way of such website(s), will be published on the website(s) for others to view along with your User ID. Your name, address and e-mail address are kept confidential, except where provided above.

Entire Agreement. This Agreement constitutes your entire Agreement with Cheviron Coaching with respect to any services.

Waiver. The failure of Cheviron Coaching to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by Cheviron Coaching must be in writing and signed by an authorized representative of Cheviron Coaching.

You further understand and agree that clicking or pressing on the "I agree" is the electronic equivalent of a written signature on this document.

Exhibit B

Acceptable and Unacceptable Activities

Acceptable Activities

Communicating with other event attendees or members about your business, referrals, questions, or mutual business issues.
Communicating with other event attendees or members regarding content of the Cheviron LIVE as well as any associated Affiliate Program(s), Community Feature(s) via Facebook and/or Kajabi, and/or website(s).
Directly exchanging business cards or personal contact information with attendees.
Connecting or maintaining relationships with permission after an event.
Directly sharing Gifts, Personal Notes, or other acts of Appreciation.

Unacceptable Activities

Promoting, marketing, or selling your business or market before, during, or after an event.
Mass distributing business cards, flyers, brochures, or gifts for sales and marketing purposes.
Setting up a booth, table, signage, or items without prior approval from Cheviron Coaching.
Sending unsolicited communications to event attendees without consent.
Promoting anything that is in conflict of interest with Cheviron Coaching’s products and services
Posting current, pending, or recently sold listings.
Posting any texts, pictures, videos, or links that are not connected to the purpose of the group.

Exhibit C

Affiliate Program

Program Names	Cheviron LIVE: Our affiliate program designed for promoting our live webinars and online events.

Affiliate Rate	Affiliates will receive a commission rate of 5% on the total sales generated through their referrals. The commission is set for the lifetime of that customer's subscription.
Eligibility	Individuals and businesses interested in promoting our programs are welcome to join our affiliate program. You do not have to purchase or be an active member in our programs to promote them.
Registration	Prospective affiliates must complete the online registration form on our official affiliate portal. Email [email protected] to request access to the affiliate portal.
Approval Process	Once registered, each affiliate application will be reviewed for suitability. Approval is at the discretion of Cheviron Coaching, LLC.
Affiliate Links	Affiliates will be provided with unique tracking links to place on their websites, blogs, or social media. The referral conversion window is 30 days after a customer has clicked the affiliate link.
Reporting, Tracking, and Analytics	Clicks: The total number of clicks on all Affiliate Share Links. Conversions: The total number of Offer purchases tracked through your Affiliate Share Links Conversion Rate - Overall conversions divided by overall clicks
Commission Payouts	Commissions will be paid out on a monthly basis, within 15 days after the end of each month. Payout’s are done through PayPal. Cheviron Coaching is not responsible for any fees, expenses, etc. related to the use of PayPal and/or any other payment portal utilized. Cheviron Coaching has the option to change, modify, edit, etc. at their discretion.
Compliance	Affiliates must adhere to our code of conduct and marketing guidelines when promoting our programs.
Termination	We reserve the right to terminate an affiliate's participation for violations of terms or inappropriate conduct.
Support	Our affiliate support team can assist with any queries or technical issues related to the program. [email protected]
Modifications	We may update these terms occasionally. Affiliates will be notified of any changes via email.
Agreement Duration	The affiliate agreement is ongoing, and either party may terminate it with a written notice.

Affiliate Program Code of Conduct and Marketing Guidelines

To ensure a positive and ethical affiliate program experience, we require all affiliates participating in the Cheviron Coaching LIVE to adhere to the following code of conduct and marketing guidelines:

Honesty and Transparency:

Represent our programs accurately and truthfully in all promotional materials.
Clearly disclose your affiliate relationship and use of affiliate links when promoting our programs.

Ethical Marketing Practices:

Do not engage in any misleading, deceptive, or unethical marketing tactics.
Avoid spamming, including sending unsolicited emails or messages to promote our programs.

Respect for Brand Identity:

Use our official logos, banners, and promotional materials provided in the affiliate portal.
Do not create your own marketing materials that could misrepresent our brand or programs.

Quality of Content:

Ensure that the content you create and share aligns with our programs' quality and values.
Provide valuable and accurate information to your audience about our programs.

Appropriate Target Audience:

Promote our programs to relevant audiences who would genuinely benefit from them.
Avoid targeting inappropriate or unrelated audiences.

Compliance with Laws:

Abide by all local, regional, and international laws and regulations related to affiliate marketing and online promotions.

Social Media Guidelines:

When using social media, clearly disclose your affiliate relationship in captions or posts.
Respect the terms and policies of the social media platforms you use.

Trademark and Copyright Usage:

Respect our intellectual property rights and do not use our trademarks, logos, or copyrighted materials without permission.

Avoid Negative Practices:

Do not engage in negative or harmful advertising against our competitors or other affiliates.
Refrain from using clickbait or sensationalized content to attract clicks.

Compliance with Program Terms:

Follow the terms and conditions outlined in the affiliate program terms document.
Adhere to the commission rate and payout structure specified for Cheviron Coaching LIVE.

Communication with Affiliates:

Maintain a respectful and professional tone when communicating with other affiliates or our support team.

Feedback and Improvement:

Provide constructive feedback to help us improve the affiliate program and our programs themselves.

Failure to adhere to these guidelines may result in the termination of your affiliate account. We value our affiliates as partners in success and appreciate your commitment to promoting our Cheviron Coaching LIVE program in a responsible and ethical manner.
